1.1 Who can use the Profeat.Team Services

Profeat.Team welcomes users of all ages, but you must be at least 13 to use most of the Services, and at least 18 to use Profeat.Team Shopping.

You must be at least 18 to use Profeat.Team Shopping (unless otherwise specified in the International Terms section applicable to specific jurisdictions). If you are between the ages of 13-18, you may use our other Services (excluding Profeat.Team Shopping) only with the supervision and consent of a parent or guardian. No individual under these age limits may use the Services, provide any Personal Data to Profeat.Team, or otherwise submit Personal Data through the Services (e.g., a name, address, telephone number, or email address).

1.2 Your Account

You may need to create an Profeat.Team account to access the Services, and it's important that the information associated with your account is accurate and up-to-date (particularly your email address - if you ever forget your password, a working email address is often the only way for us to verify your identity and help you log back in).

You may need to register for an Profeat.Team account to access or use certain Services. Your account may also automatically provide you access and means to use any new Services.

When you create an account for any of our Services, you must provide us with accurate and complete information as prompted by the account creation and registration process, and keep that information up to date. Otherwise, some of our Services may not operate correctly, and we may not be able to contact you with important notices.

You are responsible for maintaining the confidentiality of any and all actions that take place while using your account, and must notify our Support Team right away of any actual or suspected loss, theft, or unauthorized use of your account or account password. We are not responsible for any loss that results from unauthorized use of your username and password.

If you are a resident of the European Union: You have the right to delete your account with us by contacting our Support Team. If you choose to permanently delete your account, the non-public Personal Data that we have associated with your account will also be deleted.


1.3 Service Updates, Changes and Limitations

Our Services are constantly evolving. With the launch of new products, services, and features, we need the flexibility to make changes, impose limits, and occasionally suspend or terminate certain Services. We may also update our Services, which might not work properly if you don't install the updates.

The Services change frequently, and their form and functionality may change without prior notice to you.

We may provide updates (including automatic updates) for certain Services as and when we see fit. This may include upgrades, modifications, bug fixes, patches and other error corrections and/or new features (collectively, "Updates"). Certain portions of our Services may not properly operate if you do not install all Updates. You acknowledge and agree that the Service may not work properly if you do not allow such Updates and you expressly consent to automatic Updates. Further, you agree that the Terms (and any additional modifications of the same) will apply to any and all Updates to the Services. We may change, suspend, or discontinue any or all of the Services at any time, including the availability of any product, feature, database, or Content. In addition, we have no obligation to provide any Updates or to continue to provide or enable any particular features or functionality of any Service. We may also impose limits on certain Services or restrict your access to part or all of the Services without notice or liability.


1.4 Service Monitoring and Suspension

We reserve the right to refuse to provide the Services to anyone, and can monitor, terminate or suspend your account or access to the Services at any time.

We reserve the right, but have no obligation, to monitor any accounts and/or activities conducted through or in any way related to the Services (including inviting a fellow user into a community or group), as well as any user's use of or access to Personal Data, and profiles of other users.

We may also deactivate, terminate or suspend your account or access to certain Services at any time: (1) if we, in our sole discretion, determine you are or have been in violation of these Terms or the spirit thereof (as highlighted in our Community Guidelines), (2) if we, in our sole discretion, determine you have created risk or possible legal exposure for Profeat.Team, the general public, any third party, or any user of our Services, (3) in response to requests by law enforcement or other government agencies, (4) upon discontinuation or material modification of any Services, or (5) due to unexpected technical issues or problems. We will endeavor to notify you by email or the next time you attempt to access your account after any such deactivation, termination or suspension.


1.5 Security

Please let us know right away if you believe your account has been hacked or compromised.

We care about the security of our users. While we work hard to protect the security of your Personal Data, User-Generated Content, and account, we cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify our Support Team immediately of any actual or suspected breach or unauthorized access or use of your account.

  • Make a purchase, online or in-store; we may offer third party payment options such as WeChat pay, Apple Pay, and others.
  • Visit one of our retail store locations, including your in-store interactions such as using our mobile charging stations.
  • Use location-based services, such as locating a nearby store.
  • Interact with our online Services, which may have tracking technologies, such as cookies, that we or our vendors place on our online services, or which may have external party features or services, such as social media network tools.
  • Take fitness tests or assessments; share content or achievements; or invite friends.
  • Participate in our contests, events, or other promotions.
  • Participate in a survey, participate in a focus group, test out our gear, or provide your thoughts Services, marketing, or products (e.g., product ratings and reviews).
  • Interact with or sign up for our advertising or marketing, including targeted ads or marketing communications, such as emails.
  • Use our or other connected gear or devices, such as those made by other companies, to interact with our Services, such as connected shoes or activity trackers.

We, and our vendors, may also receive personal data from a variety of sources, including your devices, or from other sources including external parties such as advertising networks, service providers (including Internet service providers or ISPs), operating systems and platforms, data analytics providers, government entities, social networks, and data brokers.

Personal data that we collect may include the following:

  • Contact information: Name, email address, phone number, billing and mailing address, zip code.

  • Unique identifiers: This may include your username (and password), IP address, online identifiers, online advertising identifiers, and device identifiers or serial numbers.

  • Customer records: This may include your birth date, signature, education, payment information (e.g., credit card number, debit card number), and your sport/event, position, expected graduating year, school, and location.

  • Personal characteristics or traits: This includes demographic data, including those regarding characteristics protected by law, gender, and physical characteristics or description.

  • Commercial Information: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

  • Internet/Network Information: such as browsing history, search history, usage information, information regarding a consumer's interaction with our website, application, or advertisement.

  • Geolocation Data: This may include your physical location or movements and travel pattern, including your approximate or precise geolocation.

  • Audio, electronic, visual, thermal, olfactory or similar information: This includes audio recordings of customer service calls, in-store interaction data such as security camera footage, RFID tags (included in apparel and other gear to prevent fraud and loss prevention), and WiFi sensors (such as proximity to certain gear in relation to the sensor).

  • Fitness data: This includes workout data, steps, acceleration, speed, ground contact time, foot strike angle, position, number of steps per session, stride length, cadence, airtime, data you provide related to your lifestyle (e.g., sleeping habits), caloric intake, nutritional statistics, life events, fitness goals, height, weight, fitness level, heart rate, resting heart rate, sleep data, BMI, shoe size, and similar types of data relating to physiological condition, and activity.

  • User generated content: This includes any content or material you publish, post, or submit to us, such as photos and videos.

  • Device-provided data: For example, data collected from devices you use to access our Services, including data sent to us through App permissions, as well as sensor altitude, air pressure, change in position, device operating system, Bluetooth address, UPC, or purchase or device related information of that connected gear, and device interactions connected to our Services.

  • Promotions data: Achievements and personal records, leaderboards, tax information, waivers and releases.

  • Inferences derived from personal data: This may include information about your characteristics, behavior, attitudes, aptitudes, interests or preferences, which could include inferences derived from your use of connected gear.

  • Grant application data: Where we assist you with applying for a grant through our volunteer programs, we may collect financial information (e.g., taxpayer identification number, budget information), and track record data.

  • External Service Information: We may obtain information about you from external services, such as where you choose to use a Services feature provided by an external party. For example, when you use a social media account to register or log into your account, we may collect information about you in connection with social networking services (e.g., your public profile, friend list, people you follow or who follow you, your email address, birthday, work history, education history, interests, current city, website, personal description and likes, and your friends' birthdays, education histories, personal descriptions and likes). We may also supplement certain information that we collect from you with outside records. External parties may provide us with information about you in connection with a co-marketing agreement or in connection with a tracking technology.

Our Services may have settings available to you, depending on the Service, to allow you to set your preferences. For example, settings that allow you to control the privacy of your profiles, routes, and workouts, and change your push notification settings. Note that Information collected through our various Services, such as between our Websites and Apps, may not be synchronized (especially when you are not logged into one Service, and you are logged into another). Where information is not synchronized and you would like to have consistent settings, you may contact our Support Team if you have any issues or make sure your settings across Services are consistent by accessing each Service independently.

If you receive marketing emails from us, you may opt out through the email's instructions, as provided. Please note that regardless of your email preferences, we may send you notifications pertaining to the performance of our services, such as revision of our Terms or this Privacy Policy or other formal communications relating to products or services you have purchased or use.

If you receive marketing texts from us, you may opt out by texting "STOP" to the number contacting you.
